Services conducted by our professional consultants will incur the following schedule of fees (per person) in addition to any fees imposed by third party supplies and service providers. 1.0 Responsibility Clause:
1.1 All services, vouchers, receipts, and tickets are reserved and issued subject to the terms and conditions specified by the suppliers (refer to individual brochures and/or websites). By accepting the vouchers, tickets and utilising Our services, You agree that, apart from certain rights you have under the Australian Consumer Law that we cannot alter, neither Spark Travel nor any subsidiary company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of our services to you.
1.2 It is Your responsibility to ensure you comply with passport and other identification requirements, as well as visa requirements and regulations before travelling, your consultant can advise you of these requirements.
1.3 It is also Your responsibility that all names are provided as per government issued photo ID, (e.g. Passport, Drivers licence, Proof of Age).
1.4 The supplier and airline refund process can consist of months of investigation, Spark Travel will assist this process however does not take any responsibility for the length of time taken by them. Where payment has been made to the supplier, Spark Travel will not provide a refund to You until the funds have been received back from that supplier.
1.5 All travel involves risks. It is recommend you take out comprehensive travel insurance with a reputable insurance company to cover you against risks associated with your holiday including cover for loss of luggage, medical expenses and costs and expenses incurred due to cancellations, delays or other disruptions. It is your responsibility to ensure you are covered by travel insurance.
2.0 General:
2.1 Your Itinerary does not form part of the Contract
2.2 Spark Travel may amend these Conditions from time to time. If we amend the Conditions, we will publish the amended version on our website. We will also provide the current version of the Conditions to you upon request. You will be bound by the current version of the Conditions at the time you make Your booking.
2.3 All bookings are subject to final auditing of accounts prior to final payment, Spark Travel reserve the right to charge revised cost upon final payment of your booking resulting from any fluctuations in charges.
3.0 Cheque & Electronic Payments:
3.1 Personal, bank, company cheques or electronic payments are accepted however can take at least 3-7 working days to clear.
3.2 Should a payment be provided without the relevant clearance period, penalties may apply or could result in the automatic cancellation of Your booking. Your consultant must be notified of all payments made by electronic transfer for identification purposes, failure to do so could result in the cancellation of Your booking.
4.0 Reservation Deposit:
4.1 The Reservation Deposit (NON-REFUNDABLE) is payable at the time the reservation is requested and is in addition to any deposits charged by the tour operator/airline or other travel supplier.
You must pay your Reservation Deposit within the timeframe specified by your consultant after making your booking. If Spark Travel do not receive your Reservation Deposit within the specified timeframe after You make your booking, your booking will automatically cancel without further notice to You.
4.2 The Reservation Deposit is non-refundable BUT if you proceed with the booking the amount of the Reservation Deposit will be credited against the final amount payable. Upon cancellation, the Reservation Deposit is forfeited.
4.3 By paying your reservation deposit or otherwise paying any part of the price of your booking You confirm your understanding and acceptance of the Terms and Conditions as detailed in this contract. If You do not understand and accept the conditions and the terms of the contract, you should not make any payment to Spark Travel and in this case, we will cancel your booking.
5.0 Cancellations:
5.1 You may cancel Your booking by sending Spark Travel written notice of cancellation. In addition to any fees charged by airlines, wholesalers & suppliers, Spark Travel cancellation fee will apply.
Spark Travel cancellation fees are list in the schedule of services table.
5.2 A change of name for a guest or a change to the tour departure date is considered a cancellation of the original booking and is subject to cancellation conditions.
6.0 Travel Insurance:
6.1 In many cases, cancellation costs may be claimed against your insurance policy, and accordingly, travel insurance is strongly recommended. A recommended Insurance Policy will be automatically included in your statement. If you choose not to undertake our insurance, we will ask you to sign an indemnity declaration. Travel Insurance provides cover when the premium is paid and the policy issued, and so should be taken out as soon as any deposit or payment is made for maximum protection.
7.0 Authority:
7.1 Spark Travel will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions. You warrant that you are over the age of eighteen (18) and have sufficient funds to pay for the travel services. You have read our T&C’s and if booking for third parties have conveyed these T&C’s to them. You have read the T&C’s of any suppliers or third-party service providers and agree to be bound by those. You are responsible for checking the accuracy of all documents provided to you.
8.0 Special Requests:
8.1 Special requests such as airline seating, meals, non-smoking rooms, bedding configuration, specific room requests in hotels and cruise cabin location, are at the discretion of the operator.
Whilst Spark Travel will do our utmost to notify the operators of your special needs there is no guarantee, and We take no responsibility if these requests are not granted.
9.0 Home Transfer Service:
9.1 If Your Booking is inclusive of home transfers the following will apply:
9.1.1 Out of zone surcharges, your Spark Travel consultant will confirm with you at time of booking if your designated pick-up location is within the zone for complementary pick-up. Any out of zone surcharges will need to be paid at the time of booking.
9.2 In the event where a vehicle has not arrived by the disclosed time, You must contact the transfer company directly to ascertain the location of Your driver. If a sufficient timeframe has lapsed and the driver still has not shown, it is Your responsibility to make your own way to the departure point in time for your designated departure. Transfer company and where possible Spark Travel must be advised that this is the case, retaining proof of out of pocket expense to be reimbursement on your return.
9.3 Decision to not partake in this service will not result in any reduction of package prices or compensation.
10.0 Privacy Policy:
10.1 Spark Travel is committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy. We will only disclose your personal
information to ensure accuracy of reservations made on your behalf. We will provide relevant information to third-party suppliers such as hotels, tour companies, foreign consulates, etc. as required for your booking. Full details of the Spark Travel Privacy Policy are available on our website.
11.0 Complaint Policy:
11.1 Spark Travel Complaints Policy designed to provide guidance to both our customers and staff on the manner in which we receive and manage your complaint. The purpose of this policy is to ensure that all complaints are handled properly and that all customer complaints or comments are taken seriously. We expect to be committed to fair, effective and efficient complaint handling. Full details of the Spark Travel Complaints Handling Policy and Procedures are available on our website.
11.2 If you are dissatisfied with the complaint outcome, you may escalate your complaint to the Australian Federation of Travel Agents (AFTA), for external review under their AFTA Travel Accreditation Scheme (ATAS). As an ATAS participant we have agreed to be bound by the Code. If you would like to know more about the Code you can visit the ATAS website www.atas.com.au.
12.0 “Force Majeure Event”: means any act of God, war, terrorism, fire, flood or any other extreme weather conditions or act of nature, loss of power, epidemics or pandemics, industrial disputes,
slowdowns or other strike activities, political unrest, riots or civil disturbances, prohibitions or acts of government, semi government or other authorities, inability to obtain any necessary licence or
consent and delays caused by sub-contractors, suppliers or other third parties (including telecommunications carriers), material shortages or other disruption to the Tour beyond the control of Spark Travel.
12.1 If, as a result of the occurrence of a Force Majeure Event, We:
12.1.1 Cancel or delay the departure of a Tour prior to the departure date, We will:
12.1.1.1 cancel Your Booking and terminate the Contract;
12.1.1.2 cancel or delay the departure of a Tour prior to the tour start date, We will:
12.1.1.3 issue You with a Future Travel Credit to the value of all monies You have paid directly to Spark Travel for the cancelled Booking, and
12.1.1.4 not refund any amounts You have paid directly to Spark Travel for the cancelled Booking,
12.1.2 Cancel a Tour after commencement, We will:
12.1.2.1 cancel Your Booking and terminate the Contract;
12.1.2.2 issue You with a Future Travel Credit to the value of the unused Tour Price You have paid directly to Spark Travel for the cancelled Booking, and
12.1.2.3 not refund any amounts You have paid directly to Spark Travel for the cancelled Booking;
12.1.3 Issue a Future Travel Credit (FTC) to You:
12.1.3.1 You may apply FTC towards any future booking within the specified date specified at time of cancellation of Booking.
12.1.3.2 You may, with written consent, which we will not unreasonably refuse, transfer it to another person to apply towards any future Booking specified date specified at time of cancellation of Booking;
12.1.3.3 its use for any future booking is subject to availability;
12.1.3.4 It is not redeemable in whole or in part for cash and will expire to the extent it is not used; and
12.1.3.5 You (or the person to whom it is transferred) must pay any shortfall between the value of the Future Travel Credit and the Tour Price for the new Booking
12.1.4 Where a third-party supplier, e.g. Airline, cruise line, tour operator, has specified You are entitled to a full or partial refund, this will be adhered to under the Australian Consumer Law Act (ACL), inclusive terms under clause 1.4 of this contract.
12.1.4.1 In the event of third-party insolvency any future travel credit or un-processed refunds will not be honoured by Spark Travel.
